GİZEM KIŞ – DISTANCE SALES AGREEMENT
Article 1 – Subject
The subject of this Agreement is the rights and obligations of the parties, pursuant to the provisions of the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, regarding the sale and delivery of the product sold by the SELLER to the BUYER, whose characteristics and sale price are specified below.

Article 2.2 – Buyer Information
The customer who places an order on the www.gizemkis.com online store. The address and contact details provided at the time of ordering shall apply.
Article 3 – Product Information Subject to the Agreement
The type, quantity, brand/model, colour, size, number of items, sale price, payment method and delivery details of the goods/product(s) consist of the information contained in the order summary at the time the order is completed.
Article 4 – General Provisions
4.1 – The BUYER declares that they have read and are informed of all preliminary information regarding the basic characteristics, sale price, payment method and delivery of the product(s) subject to this Agreement as specified in Article 3, and that they have given the necessary confirmation electronically.
4.2 – As the products subject to this Agreement are made to order, they shall be dispatched within the preparation period stated on the product page and in the preliminary information, provided that the statutory 30-day period is not exceeded, and delivered to the address specified by the BUYER. This period may be extended by a maximum of 10 additional days, provided the BUYER is notified in advance.
4.3 – If the product subject to this Agreement is to be delivered to a person/organisation other than the BUYER, the SELLER cannot be held responsible if the recipient person/organisation refuses to accept delivery.
4.4 – The SELLER is responsible for delivering the product subject to this Agreement in sound, complete condition and in accordance with the characteristics specified in the order.
4.5 – Delivery of the product is conditional upon payment of the price by the payment method chosen by the BUYER. If, for any reason, the product price is not paid or the payment is cancelled in the bank records, the SELLER shall be deemed released from the obligation to deliver the product.
4.6 – If, after delivery of the product, the relevant bank or financial institution fails to pay the product price to the SELLER because the BUYER's credit card was used unfairly or unlawfully by unauthorised persons through no fault of the BUYER, the BUYER must return the product to the SELLER within 3 days, provided that it has been delivered to them. In this case, the shipping costs shall be borne by the BUYER.
4.7 – If the SELLER is unable to deliver the product subject to this Agreement within the specified period due to force majeure or extraordinary circumstances such as adverse weather conditions or interruption of transport that prevent shipment, the SELLER is obliged to inform the BUYER. In this case, the BUYER may exercise one of the following rights: cancel the order, have the product replaced with an equivalent if available, and/or postpone delivery until the obstacle is removed. If the BUYER cancels the order, the amount paid shall be refunded within 14 days.
4.8 – Products with manufacturing defects may be returned to the SELLER for the necessary repair or replacement, provided that the defect is reported within 3 days of delivery; in this case, the shipping costs shall be borne by the SELLER.
4.9 – This Agreement enters into force upon electronic confirmation of the order by the BUYER.
Article 5 – Right of Withdrawal
Gizem Kış evening dresses are made to order according to the size and model selected by the BUYER. Pursuant to Article 15(c) of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for contracts relating to goods prepared in line with the consumer's wishes or personal needs. Therefore, returns are not accepted for made-to-order products. The BUYER should choose their size carefully before ordering and contact the SELLER if in doubt.
Article 6 – Order Cancellation
An order may be cancelled free of charge by the BUYER before it enters production; the amount paid shall be refunded within 14 days. Once tailoring of the product has begun, the order cannot be cancelled. In the case of cancellations arising from the SELLER, no fee shall be charged to the BUYER and the full amount paid shall be refunded. Article 7 – Competent Court
In disputes arising from this Agreement, Consumer Arbitration Committees shall have jurisdiction up to the value announced by the Ministry of Trade, and the Consumer Courts in the place of residence of the BUYER or the SELLER shall have jurisdiction for disputes exceeding this value.
